Terms of Service

These Terms of Service ("Terms") govern your access to and use of TypoFox (typofox.com), a Software-as-a-Service tool operated by dryven GmbH ("we", "us", "TypoFox"). By creating an account or using TypoFox, you ("Customer", "you") agree to these Terms.


1. Provider

2. Business Customers Only (B2B)

2.1. TypoFox is offered exclusively to businesses, freelancers, public entities, associations and other professionals acting in the exercise of their trade, business, craft or profession. Consumers within the meaning of Section 1 of the Austrian Consumer Protection Act (KSchG) and equivalent provisions of other EU jurisdictions are not eligible to purchase or use TypoFox.

2.2. By placing an order, you confirm that you are acting in a professional or business capacity. We may require you to provide a valid VAT ID, business registration or comparable proof. We reserve the right to refuse, suspend or terminate accounts that are not used in a business capacity.

2.3. Statutory consumer rights — in particular the 14-day right of withdrawal under the Austrian Distance and Off-Premises Contracts Act (FAGG) — do not apply to these Terms.

3. Merchant of Record

3.1. Paddle.com Market Ltd (Judd House, 18-29 Mora Street, London EC1V 8BT, United Kingdom) and Paddle.com Inc. for US transactions (collectively "Paddle") are the Merchant of Record for all orders placed through TypoFox. Paddle handles payment processing, invoicing, sales tax/VAT and the handling of refunds.

3.2. When you make a purchase, Paddle's Buyer Terms (https://www.paddle.com/legal/checkout-buyer-terms) and Privacy Policy (https://www.paddle.com/legal/privacy) apply in addition to these Terms.

3.3. Customer service inquiries regarding payment, invoicing and refunds may be directed to support@typofox.com or to Paddle directly.

4. The Service

4.1. TypoFox is a Software-as-a-Service tool that crawls websites of a domain you specify and uses artificial intelligence (in particular Large Language Models provided by OpenAI) to identify spelling and grammar errors and to generate correction suggestions.

4.2. Plans and page allowances. Each subscription includes a monthly page allowance. Scanning one page consumes one page from your allowance. You may choose between weekly or monthly check schedules. Weekly schedules are subject to a per-run cap, as set out in the plan description on typofox.com/pricing.

4.4. Top-up pages. You may purchase additional one-off page bundles (e.g. 50, 100, 200, 500 pages). Top-up pages do not expire and are consumed after the included monthly allowance has been used up.

4.5. Allowance reset. Included monthly pages reset on the renewal date of your subscription. Unused included pages do not roll over.

4.6. Free plan. The Free plan is provided "as is" and may be modified, limited or discontinued at any time. There is no automatic upgrade to a paid plan.

4.7. AI-generated results. TypoFox uses probabilistic AI systems. We do not guarantee that all spelling or grammar errors will be detected or that correction suggestions are always accurate. Output requires human review ("Human in the Loop"). You are solely responsible for any decision based on the output.

5. Account Registration

5.1. To use TypoFox, you must create an account and provide accurate, current and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

5.2. You must notify us immediately at support@typofox.com of any unauthorised use of your account.

5.3. Minimum age for the natural person registering an account is 18 years.

6. Permitted Use and Customer Obligations

6.1. You warrant that for every domain you submit for scanning, you either (a) own the domain or (b) hold the explicit authorisation of the domain owner to have its content crawled and analysed by TypoFox.

6.2. You will not:

  • scan domains you do not own or are not authorised to scan;
  • use the service to crawl content in violation of robots.txt, rate limits, paywalls or terms of service of third-party sites;
  • attempt to reverse engineer, decompile, scrape, resell or sublicense the service;
  • use the service to process unlawful, infringing, defamatory or otherwise objectionable content;
  • circumvent allowance limits, security or authentication mechanisms;
  • use the service to develop a competing product;
  • use automated means to access the service other than the official API (if and when made available).

6.3. We may suspend or terminate accounts that violate this Section 6 without prior notice and without refund.

7. Subscription, Renewal and Cancellation

7.1. Paid subscriptions are billed monthly in advance through Paddle. The subscription automatically renews at the end of each monthly billing cycle for the same period at the then-current price, unless cancelled before renewal.

7.2. You may cancel your subscription at any time in your account settings or via Paddle. Cancellation takes effect at the end of the current billing cycle. You retain access until the end of the paid period.

7.3. No pro-rata refunds are issued for partial monthly use after the 14-day money-back window described in our Refund Policy (https://typofox.com/legal/refund).

7.4. Plan changes. Upgrades take effect immediately; the new monthly price is charged pro-rata for the remainder of the cycle by Paddle. Downgrades take effect at the start of the next billing cycle.

8. Prices and Taxes

8.1. All prices are in US dollars (USD) and are exclusive of any applicable taxes. Paddle calculates and adds applicable VAT, sales tax or similar taxes at checkout based on your billing location.

8.2. We may change prices at any time. Price changes take effect for new billing cycles after at least 30 days' prior notice by email. If you do not agree to a price change, you may cancel before the new price takes effect.

9. Intellectual Property

9.1. TypoFox, including all software, design, content, trademarks and documentation, remains the exclusive property of dryven GmbH and its licensors.

9.2. During the term of the subscription, we grant you a limited, non-exclusive, non-transferable, non-sublicensable right to use TypoFox in accordance with these Terms.

9.3. Customer content and output. You retain all rights in the website content you submit for scanning. You receive a worldwide, royalty-free right to use the correction suggestions and reports generated by TypoFox for your own business purposes.

9.4. Feedback. If you provide feedback or suggestions, you grant us a non-exclusive, royalty-free, perpetual licence to use them without obligation to you.

10. Service Availability and Support

10.1. We aim to provide a high level of availability but do not guarantee uninterrupted, error-free or secure operation. Scheduled maintenance will be announced in advance where reasonably possible.

10.2. Support is provided by email at support@typofox.com on Austrian business days, generally with a response time within two business days. No specific service levels (SLAs) are guaranteed unless agreed in a separate written agreement.

11. Third-Party Services

11.1. TypoFox uses third-party services (in particular Google Cloud, Supabase, OpenAI and Paddle). The use of these services is governed by their respective terms and privacy policies. Sub-processors involved in the processing of personal data are listed in our Privacy Policy (https://typofox.com/legal/privacy).

11.2. We are not responsible for the availability, accuracy or content of third-party services.

12. Confidentiality

12.1. Each party shall keep confidential any non-public information received from the other party that is marked as confidential or that should reasonably be considered confidential, and shall use it only for the performance of these Terms.

12.2. This obligation does not apply to information that (a) is or becomes publicly known without breach of this Section, (b) is rightfully received from a third party without confidentiality obligation, or (c) must be disclosed by law.

13. Data Protection

13.1. The processing of personal data is governed by our Privacy Policy (https://typofox.com/legal/privacy), which forms an integral part of these Terms and includes a Data Processing Agreement pursuant to Article 28 GDPR.

14. Warranties and Disclaimers

14.1. TypoFox is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement.

14.2. We do not warrant that the service will detect all errors, that results are accurate, complete or fit for any specific purpose, or that the service is free from defects, viruses or interruptions.

15. Limitation of Liability

15.1. To the maximum extent permitted by Austrian law:

(a) we are liable without limitation for damages caused by intent or gross negligence, for damages from injury to life, body or health, and where mandatory law (in particular the Austrian Product Liability Act) applies;

(b) for damages caused by slight negligence in the breach of material contractual obligations ("cardinal duties"), our liability is limited to foreseeable damages typical for this type of contract, capped per case at the amount paid by you to Paddle for TypoFox in the twelve (12) months preceding the event giving rise to the claim;

(c) any other liability for slight negligence — including for indirect damages, loss of profits, loss of data, business interruption or third-party claims — is excluded.

15.2. Claims for damages are time-barred within one year of becoming aware of the damage and the party causing it, but no later than three years after the event.

16. Indemnification

16.1. You will indemnify and hold us harmless from any third-party claims, damages, costs and expenses (including reasonable legal fees) arising from (a) your breach of these Terms, (b) your unauthorised scanning of domains, or (c) your violation of applicable law in connection with your use of TypoFox.

17. Term and Termination

17.1. These Terms apply for as long as you have an active account.

17.2. Either party may terminate for cause without notice if the other party materially breaches these Terms and fails to cure within 14 days after written notice (where curable).

17.3. Upon termination, your access to the service ends. We may delete your account and associated data after 30 days, subject to statutory retention obligations (in particular under the Austrian Federal Fiscal Code).

18. Changes to the Service and These Terms

18.1. We may update these Terms at any time. Material changes will be notified by email to your registered address at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance. If you do not agree, you may terminate before the effective date.

18.2. We may modify, add or remove features at our discretion. Material reductions of functionality in paid plans entitle you to terminate with effect from the change.

19. Assignment

19.1. You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition or sale of assets.

20. Governing Law and Jurisdiction

20.1. These Terms are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law rules.

20.2. Exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is the competent court of St. Pölten, Austria.

21. Miscellaneous

21.1. Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose of the original.

21.2. Failure to enforce any right does not constitute a waiver of that right.

21.3. These Terms, together with the Privacy Policy and the Refund Policy, constitute the entire agreement between you and us regarding TypoFox and supersede any prior agreements on the subject matter.
